No. Because DWI isn’t prosecuted as a criminal matter, you’ll face a trial that is presided over by a Municipal Court Judge who will hear the evidence against you, listen to your defense, and who will issue rulings on any disputes over fact or law in the case.
Eventually, the judge will determine whether or not you are guilty, and if convicted, will sentence you based on the facts of your case.
Conviction is not a given in NJ DWI cases.
